These Terms and Conditions govern the sale of products by The Flat Roofing Shop Ltd through our website. By placing an order with us, you agree to be bound by these Terms and Conditions.

Please read them carefully before placing an order. If you have any questions about these Terms, please contact us before purchasing.

References to "we", "us" and "our" throughout these Terms mean The Flat Roofing Shop Ltd.

References to "you" and "your" mean the customer purchasing products from us.

2. Our Agreement With You

When you place an order through our website, you are making an offer to purchase goods from us.

Submitting an order does not mean it has been accepted.

Acceptance of your order takes place when we send you an Order Confirmation email confirming that your order has been accepted for processing. At that point a legally binding contract is formed between you and The Flat Roofing Shop Ltd.

If we are unable to accept your order, we will notify you as soon as reasonably possible and refund any payment already received.

Examples of circumstances where we may be unable to accept an order include:

  • Products becoming unavailable

  • Pricing errors

  • Incorrect product information

  • Payment authorisation failure

  • Delivery restrictions

  • Suspected fraudulent activity

  • Circumstances beyond our reasonable control

Each order is assigned a unique order number. Please quote this whenever you contact us regarding your purchase.

3. Our Products

We make every reasonable effort to ensure that product descriptions, images and specifications shown on our website are accurate.

However:

  • Images are provided for illustration purposes only.

  • Colours may appear differently depending on your screen or device.

  • Packaging may differ from photographs shown.

  • Manufacturers occasionally update products without prior notice.

Where manufacturers improve or update products, we reserve the right to supply an equivalent or superior replacement where appropriate.

4. Product Measurements

Many roofing products are manufactured or cut specifically to the measurements supplied by customers.

It is your responsibility to ensure that all measurements, quantities and specifications are accurate before placing your order.

We cannot accept responsibility for incorrect measurements supplied during the ordering process.

If you are unsure how to measure your roof correctly, please contact us before ordering.

5. Pricing

All prices shown on our website are displayed in Pounds Sterling (£).

Unless otherwise stated, prices include UK VAT where applicable.

Delivery charges are calculated separately during checkout and are clearly displayed before you complete your purchase.

We take great care to ensure all pricing is accurate. Occasionally genuine pricing errors may occur.

If we discover that a product has been incorrectly priced, we reserve the right to:

  • contact you before accepting the order;

  • offer the correct price;

  • cancel the order and issue a full refund if payment has already been taken.

We are under no obligation to supply goods at an incorrect price where the pricing error is obvious and could reasonably have been recognised as a mistake.

6. Payment

Payment must be received in full before your order is processed or dispatched.

We accept payment using the methods displayed during checkout.

All payments are securely processed through our payment providers. We do not store your payment card details.

If payment cannot be authorised, your order may be delayed or cancelled.

Ownership of the goods remains with The Flat Roofing Shop Ltd until full payment has been received.

Risk in the goods passes to you once they have been delivered to the address provided during checkout.

7. Order Amendments

If you need to change your order, please contact us immediately.

We will always try to accommodate changes before your order enters production or dispatch.

Unfortunately, once certain products have entered manufacture or have been cut specifically to your requirements, amendments may no longer be possible.

Where changes are possible, additional charges or revised delivery dates may apply.

8. Cut-to-Size Products

Certain products, including EPDM rubber roofing membranes, are cut specifically to the dimensions requested by each customer.

Because these products are manufactured to your specification:

  • they cannot usually be resold;

  • cancellation rights are limited under the Consumer Contracts Regulations 2013;

  • returns may be subject to a restocking charge where applicable.

If you notice an error in your measurements or order confirmation, you should contact us immediately.

We strongly recommend checking your order confirmation as soon as it is received.

If production has already started, changes or cancellations may no longer be possible.

9. Availability

All products are offered subject to availability.

Although we make every effort to maintain accurate stock levels, availability can occasionally change unexpectedly.

If an item becomes unavailable after your order has been placed, we may:

  • offer a suitable alternative;

  • delay dispatch until stock becomes available; or

  • cancel the affected item and provide a refund.

We will always contact you before supplying an alternative product.

10. Product Information

Technical information, installation guides and product recommendations are provided for general guidance only.

It remains your responsibility to ensure products are suitable for your intended application before installation.

If you are unsure whether a product is appropriate for your project, please seek advice before ordering.

Failure to install products in accordance with the manufacturer's installation instructions may invalidate warranties.

11. Delivery

We aim to dispatch orders promptly and provide estimated delivery times on our website and during checkout. Delivery dates are estimates only and are not guaranteed.

Orders placed before the published daily cut-off time are usually processed on the same working day. Orders placed after the cut-off time, or on weekends or public holidays, will normally be processed on the next working day.

Delivery charges are calculated during checkout and depend on the products ordered and the delivery postcode.

We currently deliver throughout mainland Great Britain. Delivery to certain postcodes, islands and remote locations may be unavailable or subject to additional charges. If this applies to your order, we will contact you before dispatch.

Some products may be dispatched directly from carefully selected fulfilment partners. Your contract remains with The Flat Roofing Shop Ltd regardless of where your order is dispatched from.

12. Delivery Delays

Occasionally, deliveries may be delayed due to circumstances beyond our reasonable control, including but not limited to:

  • Severe weather

  • Traffic disruption

  • Industrial action

  • Vehicle breakdowns

  • Supplier shortages

  • Courier delays

  • Events beyond our reasonable control

If we become aware of a significant delay, we will notify you as soon as reasonably practicable.

We shall not be liable for delays caused by events outside our reasonable control, although your statutory rights remain unaffected.

13. Pallet Deliveries

Large or heavy orders may be delivered on pallets.

Pallet deliveries are made to the kerbside only. It is your responsibility to ensure suitable access for large delivery vehicles.

Drivers may assist beyond the kerbside at their own discretion, but this should not be expected and cannot be guaranteed.

If delivery cannot be completed because access is unsuitable, additional delivery charges may apply.

14. Split Deliveries

Where practical, we aim to deliver your complete order together.

However, some orders may be delivered in separate consignments where products are dispatched from different locations or require different transport methods.

You will not be charged additional delivery fees solely because your order arrives in multiple deliveries.

15. Failed Deliveries

Most deliveries require someone to accept the goods.

If delivery cannot be completed because nobody is available to receive the goods, the courier may:

  • Attempt delivery again;

  • Return the goods to their depot; or

  • Apply additional redelivery charges where applicable.

If you instruct the courier to leave goods in a safe place or with a neighbour, delivery shall be deemed complete once the goods have been left in accordance with your instructions.

The Flat Roofing Shop Ltd cannot accept responsibility for loss, theft or damage occurring after delivery has been completed in accordance with your instructions.

16. Inspection of Goods

We recommend that you inspect your order as soon as reasonably possible after delivery.

If goods appear damaged upon arrival, please note this when signing for the delivery where possible.

If any items are:

  • damaged;

  • missing; or

  • incorrect,

please notify us as soon as possible, and wherever possible within three (3) days of delivery.

Photographs may be requested to assist us in investigating the issue.

17. Your Right to Cancel

If you are purchasing as a consumer, you have legal rights under the Consumer Contracts Regulations 2013.

Unless an exception applies, you may cancel your order within fourteen (14) days of receiving your goods without giving a reason.

To exercise your right to cancel, you must notify us clearly by email before the cancellation period expires.

You must then return the goods without undue delay and no later than fourteen (14) days after notifying us.

Unless the goods are faulty or incorrectly supplied, you are responsible for the cost of returning cancelled items.

18. Exceptions to the Right to Cancel

Your statutory cancellation rights do not apply to products which are:

  • manufactured to your specification;

  • cut to size;

  • personalised;

  • custom-made;

  • sealed for hygiene or health protection reasons where the seal has been broken.

This includes cut-to-size EPDM roofing membranes and certain bespoke roofing products.

19. Returns

Our Returns & Refunds Policy forms part of these Terms and Conditions.

Returned goods should be:

  • unused;

  • complete;

  • in their original packaging where reasonably possible; and

  • in a resalable condition.

We reserve the right to reduce any refund where returned goods show signs of use or handling beyond what would reasonably be expected when inspecting products before purchase.

20. Refunds

Where a refund is due, it will normally be made using the original payment method.

Refunds will be processed after returned goods have been received and inspected.

Delivery charges will only be refunded where required by law.

Where customers selected premium delivery services, any refund of delivery costs may be limited to the cost of our standard delivery option.

21. Faulty or Incorrect Goods

Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015.

If goods are faulty, not as described, or otherwise fail to meet your legal rights, please contact us as soon as possible.

Where appropriate, we will repair, replace or refund the goods in accordance with applicable consumer legislation.

22. Product Use

Many roofing products require specialist knowledge and correct installation techniques.

Unless expressly stated otherwise, The Flat Roofing Shop Ltd does not provide installation services.

Customers are responsible for ensuring products are installed correctly and in accordance with the manufacturer's instructions.

We accept no responsibility for damage arising from incorrect installation, misuse or failure to follow installation guidance.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory consumer rights; or

  • defective products under applicable UK legislation.

Subject to the above, our total liability shall be limited to the purchase price of the products supplied.

We shall not be liable for indirect or consequential losses, including but not limited to loss of profits, business interruption or loss of commercial opportunity where products are purchased for business purposes.

24. Intellectual Property

All content displayed on this website, including text, images, graphics, logos, product descriptions and website design, is owned by or licensed to The Flat Roofing Shop Ltd.

No material may be copied, reproduced or distributed without our prior written permission except where permitted by law.

25. Privacy

We process your personal information in accordance with our Privacy Policy.

By using our website, you acknowledge that we may process your personal information for the purposes of fulfilling your order, providing customer service and complying with legal obligations.

26. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such delay results from circumstances beyond our reasonable control.

These circumstances include, but are not limited to:

  • natural disasters;

  • pandemics;

  • government restrictions;

  • industrial disputes;

  • utility failures;

  • cyber attacks;

  • transportation disruption; and

  • supplier failures beyond our reasonable control.

Where such circumstances continue for an extended period, either party may cancel the affected order and receive a refund for any undelivered goods.

27. Changes to These Terms

We may amend these Terms from time to time to reflect changes in legislation, our business practices or the products we offer.

The version published on our website at the time your order is placed will apply to your purchase.

28. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

29. Waiver

If we delay or fail to enforce any right under these Terms, this shall not prevent us from enforcing that right at a later date.

30. Transfer of Rights

We may transfer our rights and obligations under these Terms to another organisation where this does not adversely affect your legal rights.

You may not transfer your rights or obligations under these Terms without our prior written consent.

31. Third Party Rights

These Terms are between you and The Flat Roofing Shop Ltd.

No third party has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.

32. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumers have additional rights to bring proceedings in Scotland or Northern Ireland under applicable law.
